I have the right to decline any commission.

I will provide major updates. If I fail to update for over 3 weeks, a refund is allowed. Otherwise, cancellations and refunds are not permitted.

No physical item will be shipped to your home address.

Commissioned work and any retained files will not be used for AI training, or blockchain like, but not limited to, NFTs or cryptocurrency.

A project addendum will be created in the event this TOS does not cover everything needed for the project. If created, this TOS will still apply.

Communication between artist and client will be kept documented and treated with the utmost confidentiality. It will not be disclosed to any other party outside the commission itself. These include, but not limited to, personal details of both parties such as name and address, business information, PayPal email, etc.

Only public information, such as client request, will be publicly posted to the artist's Trello.

The client may not sign the commissioned artwork or claim it as their own original work. It must be credited as a commissioned piece.The client may not remove my signature in any work, even if under commercial commission.

I and my team members reserve the right to post, share, and display the artwork on social media and personal portfolios, unless stated otherwise.

If the client wishes for the artwork to remain private or not be posted, streamed, or shared publicly, this must be stated at the start of the commission.

If a client falsely claims ownership of the artwork and it is reported, I reserve the right to publicly post the image regardless of prior privacy agreements.

If the client fails to provide feedback for 7 days, the project will proceed to the next step without any revisions or checks on smaller projects (Singular Commissions, Personal and Commercial)

If the client fails to provide feedback for 30 days, the project may be considered inactive for bigger projects. (Books, Custom Stickers, Shirts, etc.)

If the project is terminated early, completed work up to that point remains with the artist for bigger custom commissions, and deleted if a singular piece.

Delays caused by late feedback or changes in direction will extend the timeline accordingly.

I reserve the right to refund or cancel the commission at any time.

Payments are accepted via PayPal. For Philippine clients, Maya and GCash are available at the current conversion rate. Local discount unavailable.

Full payment is required upfront. Returning clients may pay 50% upfront and 50% midway. As of this moment payment plans are only available through VGen's milestone system.

Do not issue a chargeback once the project has been completed.

Issuing a chargeback or forced refund will immediately forfeit any ownership or usage rights to the commissioned artwork.

Any additional charges (rush fees, significant changes, extra revisions, etc.) will be upheld by all parties involved.

Refunds will be issued based on the guaranteed delivery date of the project on VGen if project is not completed by then, or may be refunded on PayPal or other methods of payment if there has not been an update on the progress of the commission for over 3 weeks.

Commercial use of commissioned images is allowed only after consultation at any point during the commission process. Commercial usage requires an additional fee equal to +100% of the original base price.

The refunded amount is based on how much work I have already done on the project. None: 100%, Sketch: 85%, Lineart: 65%, Middle of Shading: 20%. If majority of shading is finished, even with a revision, a refund will not be issued after or upon piece completion. Refund amount is changed during bigger projects and will be discussed prior to start of project.

Unlimited revisions are allowed during the sketching phase. After the sketching phase, the client is entitled to: Up to 5 minor revisions during Lineart phase, Up to 3 major revisions during shading phase.

Major revisions may not significantly alter the overall composition of the finished piece.

At every stage of the process, the client must confirm that all presented elements are correct. Failure to do so may result in additional charges if changes are requested in later stages.

Updating or changing references before the lineart phase will not incur additional charges.

Revision limit and cost is altered during bigger project requests, with it already being included in the package with revision rounds per step.
